Legal motives in the national education (upbringing) of the Kazakh people

Abstract

The subject of study are cognitive and educational foundations of the traditional legal system of Kazakhs. The object of work is the traditional legal ideology of the Kazakh people, as a special fam- ily and national doctrine of morality.The study touches upon such gnoseological foundations of the traditional legal culture of the Kazakhs, as adet and some features of national identity. The nature of education in the spirit of traditional law is explainedon the basis of these heuristic settings. Particular attention is paid to the traditional interpretation of cultural values, in which the law plays the role of instrumental value as a means of stabilizing society and maintaining order in it. Authors noted the valueof orientations in nomadic societies, which played crucial role in the formation of the legal cul- tures of Kazakhs. The methodology of the research is basing on the following approaches, principles and methods of scientific research: first, a cultural and civilizational approach was used that allows to comprehend the traditional legal thought of the Kazakh people as a reflective perception of an original legal tradition in the context of the national spiritual culture; Second, in addition to traditional prin- ciples (objectivism, historicism, etc.), the method of reconstruction and restoration of state and legal views of thinkers has been widely used, legal beliefs of the people, historical and cultural traditions and customs of Kazakhs have been analyzed. The axiology of the traditional legal ideology in the Kazakh society is built on the notions of law as a means of stabilizing society and protecting absolute values and it has played an important role in the upbringing of the younger generation for many cen- turies. The traditional rights of the Kazakhs, as far as possible, were not trying to allow the reception of someone else’s legal experience.
